Onya App Tech LTD Print-on-Demand Clothing Service Terms and Conditions
Welcome to Onya App Tech LTD! By accessing or using our print-on-demand clothing service, you agree to comply with and be bound by these terms and conditions. If you do not agree with any part of these terms, please refrain from using our services.
2.1. Order Placement: All orders are subject to acceptance and availability. Onya App Tech LTD reserves the right to refuse or cancel an order for any reason, including but not limited to product availability, errors in pricing, or suspicion of fraudulent activity.
2.2. Payment: Customers are required to provide accurate and up-to-date payment information. Prices for our products are listed on our website and are subject to change without notice. Payment is processed at the time of order placement.
3.1. Copyright and Trademarks: Customers must ensure that any content, including designs and logos, submitted for printing does not infringe on any third-party copyrights or trademarks specific to fitness-related brands or establishments. Onya App Tech LTD is not responsible for any legal issues arising from copyright infringement.
3.2. Content Review: We reserve the right to review and reject any content that violates our content guidelines, including but not limited to designs promoting violence, discrimination, or illegal activities, or infringing on the intellectual property rights of others.
4.1. Production Times: The standard production time for each order is 7 business days. While we strive to fulfil orders promptly, please note that this timeframe may vary based on order volume and during peak seasons. Customers will be notified of any significant delays.
4.2. Shipping: Shipping times are estimated and may vary based on the destination. Onya App Tech LTD is not responsible for any delays or issues that may arise during the shipping process. For bulk orders to fitness facilities, please contact our customer service to discuss customised shipping options.
4.3. Delivery Cost: A delivery cost of £3.99 will be applied if a customer chooses delivery as their shipping option.
5.1. Returns: We accept returns for defective or damaged products. Customers must contact us within [number] days of receiving the order to report any issues. Returns for fitness facility-branded products will be subject to approval.
5.2. Refunds: Refunds are not offered for wrong sizing due to the custom nature of the products produced. However, we will gladly provide replacements or refunds for faulty items. Refunds for bulk orders will be assessed on a case-by-case basis.
6.1. Privacy: Customer information is handled in accordance with our Privacy Policy, which includes provisions for handling sensitive data related to fitness facilities. By using our services, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
6.2. Security: We implement industry-standard security measures to protect customer data. However, Onya App Tech LTD is not responsible for any unauthorised access or breaches. Fitness facility logos and branding details will be handled with utmost confidentiality.
These terms and conditions are governed by and construed in accordance with the laws of the UK. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in the UK.
8.1. Facility Plus Users: Facility Commitment applies only to Facility Plus Users. If you are a Facility Plus User, you will need to commit to a 12-month contract. By agreeing to these terms and conditions, you are agreeing to the 12-month contract commitment.
9.1. Embroidery Setup: As part of your setup, both Facility and Facility Plus Users can have one logo set up for embroidery at no additional cost. All other logos will need to be set up, and a set-up fee of £25 will be charged per additional embroidered logo. Print logos can be updated at no extra cost.
10.1. POS Setup: Facility Plus members will receive a point of sale (POS) setup, including one of every item in their initial store. Products in the store can be updated every 3 months. If users want to add items to their gyms in-person store, they have to do so at their own expense. This can be done at cost price.
11.1. Back Order Process: When an item goes on back order with our suppliers, we will reach out to our members with the following options:
We will inform them of the expected date of arrival of the product, which they can either wait for. Alternatively, they can choose to change for another size, colour, or product of the same value. Generally, these delays are only 1-2 weeks longer than our regular turnaround time of 7-10 business days. However, in exceptional cases, they can be longer. Members/customers will also be offered a full refund if they do not want to wait.
12.1. Print Size: Due to the nature of print-on-demand, we provide a universally sized print on all garments. This print size matches best on the size medium of the product. This means there will be a slight difference in appearance between an XS and a 2XL.
13.1. Cancellation Period: All stores/tiers have a 2-month period in which they can cancel their subscription. If they do not cancel within this time period, they then by default commit to a 12-month subscription.
